By accessing or using GigWise Active Tracker ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including drivers, free users, and paid subscribers.
GigWise Active Tracker is a location-sharing platform designed for gig economy workers (DoorDash, Uber Eats, Grubhub, etc.) to see real-time driver density and hotspot zones. The Service includes:

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4.1 Pricing: The Service costs $7.99 per month with a 7-day free trial for new users.
4.2 Lifetime Membership: The first 100 registered users receive lifetime access at no cost, provided they comply with usage requirements (20+ hours/week active, location enabled, no cheating, provide feedback).
4.3 Auto-Renewal: Subscriptions automatically renew monthly unless canceled before the renewal date.
4.4 Cancellation: You may cancel anytime through your account settings. No refunds for partial months.
4.5 Payment Processing: All payments are processed securely through Stripe. We do not store your credit card information.
4.6 Trial Period: You will not be charged during the 7-day trial. If you do not cancel before the trial ends, your subscription will begin, and you will be charged $7.99.
5.1 Location Tracking: The Service requires access to your device's GPS location while active. Your location is shared with other users in a blurred/anonymized format to protect privacy.
5.2 Ghost Mode: When you deactivate tracking, you remain visible on the map for 10 minutes ("Ghost Mode") to prevent cheating and rapid toggling.
5.3 Data Usage: We use location data to display heatmaps, calculate Gig Points, and improve the Service. See our Privacy Policy for details.
5.4 Opt-Out: You may stop sharing your location at any time by deactivating in the app or revoking location permissions in your device settings.
6.1 Earning Points: Users earn Gig Points (GP) based on active time, distance traveled, streaks, and mission completion.
6.2 Point Value: GP have no cash value and cannot be transferred, sold, or redeemed for money. They are solely for in-app rewards and leaderboard ranking.
6.3 Redemption: GP may be redeemed for rewards in our marketplace (subject to availability). We reserve the right to modify, suspend, or discontinue rewards at any time.
6.4 Anti-Cheating: Any attempt to manipulate GPS, spoof location, or cheat the point system will result in immediate account termination and forfeiture of all points.
6.5 Adjustments: We reserve the right to adjust GP balances if fraudulent activity is detected.

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, icons, images, software, and design) are owned by GigWise or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.
9.1 AS-IS Service: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
9.2 No Guarantee: We do not guarantee that the Service will be uninterrupted, error-free, or secure. Location data may be inaccurate.
9.3 Third-Party Services: The Service integrates with third-party platforms (Stripe, mapping services). We are not responsible for their performance or availability.
9.4 Limitation of Liability: To the fullest extent permitted by law, GigWise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.
9.5 Maximum Liability: Our total liability for all claims shall not exceed the amount you paid us in the 12 months prior to the claim.
You agree to indemnify, defend, and hold harmless GigWise, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
We reserve the right to modify, suspend, or discontinue the Service (or any features) at any time without notice. We may also update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or in-app notification.
We may terminate or suspend your account immediately, without prior notice, for any reason, including:
Upon termination, your right to use the Service ceases immediately. All accumulated Gig Points will be forfeited.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
You waive the right to participate in class action lawsuits or class-wide arbitration.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
