1. Purpose & Intended Use

GigWise Active Tracker is designed to help gig economy workers (delivery drivers, rideshare drivers) identify high-demand areas and optimize their work strategy. The Service displays real-time heatmaps and driver density data.

This tool is for informational purposes ONLY. It does NOT replace safe driving practices, common sense, or traffic laws.

2. Distracted Driving Risks

✖Do NOT check the app while your vehicle is in motion
✖Do NOT interact with the map, buttons, or menus while driving
✖Do NOT read notifications or mission updates while behind the wheel
✖Do NOT mount your phone in a way that obstructs your view of the road

✅ SAFE PRACTICES

✓DO pull over to a safe, legal parking spot before checking the app
✓DO turn off your engine and engage the parking brake
✓DO review heatmaps BEFORE starting your shift
✓DO use hands-free voice commands if your device supports them
✓DO prioritize safety over Gig Points or missions

3. Location Data Accuracy

The heatmaps and location data displayed in the app are approximations and may not be accurate. Location accuracy can be affected by:

GPS signal strength and satellite availability
Weather conditions, tall buildings, and interference
Device limitations and battery-saving modes
Intentional location blurring for user privacy
Network delays and data synchronization lag

Do NOT rely solely on the app for navigation or real-time demand information. Always verify with official gig platform apps (DoorDash, Uber Eats, Grubhub) before making decisions.

4. No Guarantee of Earnings

The Service provides informational data about driver density and hotspot zones. We do NOT guarantee that using the app will increase your earnings, tips, or order volume. Actual earnings depend on many factors outside our control, including:

Platform demand fluctuations and algorithms
Local market conditions and competition
Time of day, weather, and seasonal trends
Your driving efficiency, acceptance rate, and customer ratings
Platform-specific promotions and bonuses

Use the Service as a supplementary tool, not a guarantee of success.

5. Traffic Laws & Compliance

You are solely responsible for complying with all applicable traffic laws, regulations, and gig platform policies. This includes:

Obeying speed limits, traffic signals, and road signs
Using hands-free devices as required by local laws
Avoiding distracted driving (texting, app usage while driving)
Maintaining valid driver's license, insurance, and vehicle registration
Following DoorDash, Uber Eats, or Grubhub terms of service

GigWise Active Tracker is NOT affiliated with DoorDash, Uber, Grubhub, or any gig platform. Violating platform policies may result in deactivation from those services.

6. Personal Safety

6.1 Situational Awareness: Always be aware of your surroundings. Do not enter unsafe neighborhoods or unfamiliar areas late at night without taking precautions.

6.2 Vehicle Security: Lock your doors, keep valuables out of sight, and park in well-lit areas.

6.3 Emergency Contacts: Keep emergency contact numbers readily available. Call 911 if you feel threatened or witness a crime.

6.4 Fatigue: Do not drive while drowsy or impaired. Take regular breaks during long shifts.

6.5 Weather Conditions: Avoid driving in hazardous weather (ice, flooding, severe storms) if possible.

7. Technical Limitations

The Service may experience technical issues, including:

Server downtime or maintenance
GPS signal loss or inaccuracies
Mobile network connectivity issues
Battery drain from location tracking
Delayed or missing data updates

Do NOT rely on the app as your sole source of information. Always have backup plans and alternative navigation tools.

8. Health Considerations

Extended periods of driving and sitting can lead to health issues such as back pain, eye strain, and cardiovascular problems. Take regular breaks, stretch, stay hydrated, and maintain a healthy diet. If you experience pain, fatigue, or health concerns, consult a medical professional.

9. Privacy & Data Sharing

Your location is shared with other users in a blurred/anonymized format. However, no system is perfectly secure. There is always a risk of data breaches, unauthorized access, or misuse. Use the Service at your own risk. See our Privacy Policy for more details.

10. Third-Party Platforms

GigWise Active Tracker is an independent tool and is NOT endorsed, sponsored, or affiliated with DoorDash, Uber Technologies, Grubhub, or any other gig platform. Use of our Service does not guarantee compliance with third-party platform policies. You are responsible for ensuring your actions comply with all platform terms of service.

11. Liability Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, GIGWISE ACTIVE TRACKER AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Accidents, injuries, or deaths resulting from use of the Service
• Traffic violations, fines, or legal penalties
• Lost earnings, tips, or business opportunities
• Vehicle damage, theft, or mechanical failures
• Data breaches, privacy violations, or location data misuse
• Errors, inaccuracies, or omissions in heatmap data
• Service interruptions, downtime, or technical failures
• Actions taken by third-party gig platforms (deactivations, suspensions)

YOU USE THE SERVICE AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR ANY HARM OR DAMAGES ARISING FROM YOUR USE OF THE APP.

12. Assumption of Risk

By using GigWise Active Tracker, you acknowledge and accept the inherent risks of gig work, driving, and location-based services. You assume full responsibility for your safety, vehicle, earnings, and compliance with laws and platform policies.

13. Emergency Situations

IN CASE OF EMERGENCY:

🚨 Call 911 immediately for police, fire, or medical emergencies
🚗 Pull over safely if you experience vehicle trouble or feel unwell
📞 Contact roadside assistance if your vehicle breaks down
🏥 Seek medical attention if you are injured or in pain

The Service does NOT have built-in emergency features. Always call emergency services directly.

14. Minors

The Service is intended for users 18 years of age or older. Minors are prohibited from using the Service. If you are under 18, do not register or use the app.
